Katana Silicon Technologies LLC (“Katana”) announces receipt of confirmation by the United States Patent and Trademark Office (“USPTO”) that Katana’s patent number US Patent 6,291,861 B1 (“the ‘861 Patent”) is valid. GlobalFoundries, Inc., GlobalFoundries U.S. Inc., and GlobalFoundries U.S. 2 LLC (collectively “GlobalFoundries”) filed a request for the USPTO to reexamine the ‘861 Patent. The ‘861 Patent relates to MOSFET transistors having particular source and drain configurations relevant to FinFet Transistors and to state-of-the-art design and manufacturing of semiconductor devices in general. Katana has asserted the ‘861 Patent in litigation. After consideration of GlobalFoundries’s request and arguments filed by Katana, the USPTO confirmed the validity of every challenged claim in a Notice of Intent to Issue Ex Parte Reexamination Certificate issued August 26, 2024. Katana is pleased by the USPTO’s recognition of the ‘861 Patent’s strength.
Previously, The United States Patent Trial and Appeal Board has denied the institution of Inter Partes Review (IPR) IPR2022-00763 related to the ‘861 Patent on October 7, 2022.
On February 24, 2022, Katana has filed a patent infringement complaint in the US District Court for the Western District of Texas against Globalfoundries. The case number is 6:22-cv-00191. The patents at issue are US Patent 6,291,861 B1 and US Patent 7,402,903 B2.
